By accessing, viewing, or inquiring about any properties or contract rights marketed on this website or otherwise offered by Brickhaven Properties, LLC (“Brickhaven”), you agree to be bound by the following Terms of Use. These terms govern your relationship with Brickhaven as a prospective buyer and are enforceable whether you submit an inquiry online, by phone, by email, or through any third party.
1. Principal Disclosure and Role Clarification
Brickhaven Properties, LLC is acting solely as a principal in all transactions. The company is either (a) the record owner of the subject property, or (b) holds a valid and assignable purchase agreement, granting it equitable interest in the subject property. In the latter case, Brickhaven is selling or assigning its contractual rights—not the underlying property itself. Such listings will be clearly identified.
At no time is Brickhaven acting as an agent, broker, or fiduciary for any party. One or more principals of Brickhaven may hold real estate licenses; however, they are acting strictly as principals in their own transactions and not in any agency capacity.
2. Property Disclaimers and Buyer Due Diligence
All properties and contract interests are offered for sale by Brickhaven (or a related entity, as applicable) as-is and where-is, without warranty. Brickhaven makes no warranties or representations, express or implied, as to:
- The current or future condition of the property
- Its marketability, rental income, or investment suitability
- Title status, zoning, environmental condition, or code compliance
All prospective buyers are solely responsible for conducting their own due diligence before proceeding with any transaction. This includes, but is not limited to, inspections, title searches, appraisals, repair estimates, and legal or financial advice.
3. Access and Communication Restrictions
Prospective buyers shall not contact the property owner, occupant, or any other party affiliated with the property without the express written consent of Brickhaven Properties, LLC. Unauthorized contact will result in immediate disqualification from the transaction and may expose the violator to legal action.
No site visits, inspections, or drive-bys are permitted unless explicitly scheduled and confirmed by Brickhaven. Trespassing or unsolicited visits to the property may result in removal from our buyers list and legal consequences.
4. Earnest Money and Contract Terms
A non-refundable earnest deposit of $2,500 is required for all accepted offers. This deposit must be made directly to the designated title company and will be applied in accordance with the assignment or purchase agreement terms.
Contracts offered by Brickhaven may not be assigned or marketed further without prior written consent. Daisy-chaining and unauthorized marketing of Brickhaven’s deals is strictly prohibited.
5. Liquidated Damages for Breach
In the event that a prospective buyer, investor, or any affiliated party violates these Terms of Use—particularly by directly contacting a property owner without authorization or interfering with Brickhaven’s contractual interest—the violating party agrees to pay liquidated damages in the amount of $10,000.
These liquidated damages are not a penalty, but represent a reasonable estimate of the damages Brickhaven would incur due to circumvention, interference with contractual rights, reputational harm, and lost opportunity. This provision is agreed to as a material term of these Terms of Use.
6. Acknowledgment and Consent
By accessing this website, submitting an inquiry, or requesting further property details, you confirm that you:
- Have read and understood these Terms of Use
- Agree to abide by all conditions outlined herein
- Understand that Brickhaven is offering properties or equitable contract rights as a principal
- Agree not to circumvent Brickhaven or contact sellers directly
- Accept the requirement to pay liquidated damages for breach

7. Modifications
Brickhaven reserves the right to update or modify these Terms of Use at any time without prior notice. Continued engagement following any such changes constitutes acceptance of the revised terms.
